ACTION: Since the Committees have not been made official as yet this
Meeting will serve as an informational one. The meeting started at 6:40
p.m.
See attached correspondence from Miller. Miller described her issues to the Committee. The Committee expressed their concern but her issues were Contractor based and relayed to Miller that she would have to contact an attorney to get these issues rectified.
ACTION: See attached memo from Mark Shell.
After discussion the Committee stated that the City does not have legal
responsibility of the curbs and streets until the final top coat of the street
is applied and the City Engineer accesses and approves the construction. Therefore, the City can not collect a
holding fee from homeowners or contractors to assure payment if damage has been
done to the curb or street structure.
If a home is built after approval then the City will collect a fee, per
the building permit, that will be returned if there is no damage done to the
curb structure during construction of the home. The Committee asked Tate to
look into what other communities do.
ACTION: See attached memo. The Committee advised Nelis to take no action, which means the City would be considered for funding.
DISCUSSION: Miscellaneous Issues
ACTION: A developer was upset over the City policy of assessing value on a home being built. Tate explained that he uses a software based program to determine the cost of the home and the developer is then charged permit fees accordingly. The program gives a low, medium, high status and the City uses the medium status. The Committee agreed with this process.
Nelis gave an update on the burnt homes. These buildings are under the legal process at this time.
