ACTION: Alderman Orr made a motion and Alderman Mietzner seconded to open the meeting at 6:35 p.m. All yes. Motion passed.
Alderman Hoppe made a motion and Alderman Mietzner seconded to approve the August 9, 2005 minutes of the Ordinance & License Meeting and have them placed on file. All yes. Motion passed.
ACTION: Staff relayed Mr. Bell’s dilemma of renters
not paying for their water bills. The
Committee stated that this was an assumed risk being a landlord. There were options a landlord could take in
order to prevent this from happening. Committee advised staff to notify Bell of
their decision to take no action.
ACTION: It was brought to the Committee’s attention the woman that had the
“Weenie Wagon” parked out on Marathon’s property. The Committee stated that there was a 10 day limit for portable
vendors. The Committee asked that the office staff set up a procedure when
portable vendors take out a 10 day license they are to fax a copy to the Police
Department so the department has a record if they need to enforce removal.
ACTION: That Section 154.02 Fees - of the Wilmington Code of Ordinances be and is hereby deleted. (Section 157.03 is the current Ordinance that reflects this language.)
That Section 154.03 Specifications and Requirements (A) be amended to

replace with Current Code, “-
save and except such portions as are modified by the other provisions of this
Chapter 154. At least three copies have
been and are now filed in the office of the city clerk and the same are hereby
adopted and incorporated as fully as if set out at length herein. “From June 1, 1989, strike out date” - The provisions
thereof shall be controlling in the electrical installations of all buildings and
structures therein contained within the corporate limits of the City.

Alderman Orr made a motion and Alderman Hoppe seconded to amend the Ordinances as written above. All yes. Motion passed.
DISCUSSION: Wine Store
ACTION: Mayor Strong stated that he had received a call from a woman interested in opening a wine store in the downtown area. He told her as liquor commissioner he was not in support of issuing another liquor license. The Committee respectfully told the Mayor that they would be very interested in getting more information and that this would be a specialty license. Alderman Orr stated he would like to contact her. The Mayor has her number.
DISCUSSION: Insurance

ACTION: Staff brought the Committee up to speed on what the past Committee members had done on this issue. Due to the change over in the Council no final action was taken. The Committee advised Tate to write a certified letter tomorrow to the insurance company stating that a hearing will take place at the next Committee meeting whether they are here or not.
DISCUSSION: Subdivision
Ordinance
ACTION: The City Administrator, the City Attorney, Public Works Supervisor Van Duyne, Water and Sewer Supervisor Jeffries and Building Inspector Tate met twice to update the subdivision ordinance. See attached recommendations. The Committee is to review this so the next meeting it could approve the changes.
DISCUSSION: School
Intergovernmental Agreement
ACTION: The Committee reviewed past water usage from the schools along with how much it costs the City to produce water. After reviewing all the figures the Committee agreed to leave the agreement as written and send to Council for approval.
DISCUSSION: Miscellaneous
ACTION: Review for next Committee Meeting – Burn Ordinance- clarify language under unattended fires, provision to douse, contained area, restricted hours, distance between structure.
Noise
Ordinance
Unsafe structures - 1214 N. Joliet – There was a fire at 1214 N. Joliet and the Ropp Farm building. The Committee asked staff to contact Chalen Parrish to see if he could demolish the farm building.
Construction Trailer – A complaint was filed to an alderman about a construction trailer. The trailer is really a small box truck. Tate will look into this.
