City Council
March 7, 2006
Mayor Roy Strong, presiding.
The meeting was called to order with the pledge to the flag.
The clerk called the roll finding the following Aldermen present: Gilmour, Mietzner, Hermes, Strong, Johnston, Orr, Plese and Hoppe.
Absent:
Alderman Orr made a motion and Alderman Hoppe seconded to Approve the Minutes of the February 21, 2006 meeting as presented and have them placed on file. All yes. Motion passed.
An Executive Session to review past executive session minutes was held at 6:00 p.m.
Three Public Hearings were held:
Public Hearings were transcribed by Court Reporter LeAnn Hibler and are available at City Hall for public viewing.
Mayor’s Report:
Mayor Strong reminded everyone that election day was March 21 and to get out and vote.
The Mayor recognized Standard Bank for their sign improvement investment on the corner of Water and Kahler. People driving by can now view time and temperature.
Citizen’s Comments: There were none.
Planning and Zoning Committee: Alderman Mietzner made a motion and Alderman
Johnston seconded to approve the Zoning Map for 2006. All
yes. Motion passed.
Resident Bill Davy asked
what changes were made in the last year.
Executive Secretary Sheryl Puracchio stated that the annexation of 150
Operator’s property and partial annexation of JADA and an annexation correction
on Clay Stark’s property on South Route 53.
Next scheduled meeting will be March 23, 2006 at 7 pm.
Health/Safety/Building/Grounds

Water/Sewer/Streets/Alleys Committee:

Police and ESDA
Committee: The next meeting
will be Monday, March 13 at 5:30 p.m.
Finance/Administration/Land Acquisition Committee: Alderman Plese held a first reading on an
ordinance authorizing the annexation, an ordinance annexing certain territory
and an ordinance rezoning certain property, all pertaining to the Oakwest
Development on Kahler and Butcher.
Alderman Plese made
a motion and Alderman Mietzner seconded to Waive further readings and
approve Ordinance 06-03-07-01 authorizing the execution of an annexation
agreement with Old Second National Bank of Aurora and Prairie Farm L.L.C.
pending final staff review. Plese,
Gilmour, Johnston, Hermes, Orr, Mietzner, Strong, Hoppe yes. Motion passed.
Alderman Plese made
a motion and Alderman Gilmour seconded to Waive further readings and approve
Ordinance 06-03-07-02 annexing certain territory to the corporate limits of the
City of Wilmington, Will County, Illinois (Old Second National Bank of Aurora
and Prairie Farm L.L.C.) Plese, Gilmour, Johnston, Hermes, Orr, Mietzner,
Strong, Hoppe yes. Motion passed.
The next meeting will be Tuesday, March 21, at 6:30 p.m.
Ordinance and License Committee: Alderman Orr had the second reading for the Business Registration and the Park District Ordinances and the first reading for the Subdivision Ordinance.

Eric Hanson, City Attorney, explained that if the City decides to pursue a suit regarding closure of the city landfill, that was not successfully completed, the City Council could consider having Clayton Group Services, Inc. to 1) conduct a review of all closure related documentation in Mahoney, Silverman & Cross’ possession and 2) provide a verbal summary and professional opinion plus a brief written summary for an amount not to exceed $2,850. The consensus was that Jack Tyler should proceed with Clayton Group Services.
November 5, 2002 – Release all –
The purpose of the executive session was the suit filed against the city by the mayor regarding the sign ordinance. Mayor McGann has agreed to plead guilty and pay the minimum fine (court costs only) as long as the council agrees to look at revising the sign ordinance.

Police Chief Metta explained that the Wilmington police department will be joined by members of the state police, Will County police and Braidwood’s police department, this Saturday, June 21, during the demonstration of the Creativity Movement.
The Council and Attorney Hanson discussed possible litigation against the city. Hanson proposed an intergovernmental agreement between the city and the park district. This would allow the park district to continue operating as a taxing body and to pay their secretary. The city could hire Charlie Friddle as a non-union employee for a three year contract. The Council would form an advisory committee for the operation of the park. The operation and ownership of city buildings and property would belong to the city. The city’s insurance carrier has agreed to provide insurance protection for the parks if the city assumes ownership and maintenance of the parks. The trailer park will come under city ownership.

The executive session was to discuss the purchase of Tenn’s store just east of the police station. The attorney for Tenn’s appraised the building at $62,500. Alderman Gilmour was appointed to negotiate with owners on the purchase of the property. Alderman Gilmour will initially offer $55,000 and not exceed $58,000.
December 21, 2004 – Release all -
The purpose of the Executive Session was to discuss the purchase of the Tenn’s building to benefit the police department expansion as well as antenna tower placement. Alderman Gilmour stated that Joyce and Ed Sullivan have agreed to sell the property to the city for $58,000., along with the closing costs. City Attorney Mahoney stated he will look over the documents and draw up a contract (agreement) for the purchase of the property and vote on it at the next council meeting if the payment schedule so fits.

JADA: Alderman Plese stated that the annexation
agreement is presently being worked on.
City Administrator Report: John McIntyre stated that he has drawn up by-laws for the Planning & Zoning Commission. The Council has received a copy and if they have any comments please let him know.
Attorney’s Report: Attorney Fredin stated that the subdivision ordinance had been sent back to committee after the prior second reading. Several additions had been made so it came back as a first reading tonight.
Alderman Plese made a motion and Alderman Hoppe seconded to Adjourn the Meeting at 8:00 p.m. All yes. Motion passed.
