Article 1. Mayor
31.01 Election.
The mayor shall be elected for a 4-year term and shall serve until his
successor is elected and qualified as provided by statute. (‘69 Code,
§ 31.001)
31.02 Duties.
The mayor shall be the chief executive officer of the city and shall
perform such duties as may be required of him by statute or ordinance. He shall
have supervision over all of the executive officers and employees of the city
and shall have the power and authority to inspect all books and records
pertaining to city affairs and kept by any officer or employee of the city at
any reasonable time. (‘69 Code, § 31.005)

31.03 Appointment of officers.
The mayor shall appoint all officers of the city whose election or
appointment is for a period of less than one year. Any vacancies occurring in an
appointive office shall be filled in the same manner. Appointments in excess of
a 1-year term shall be with the consent of a majority of council. (‘69

31.04 Designation of officers’ duties.
Whenever there is a dispute as to the respective duties or powers of any
appointed officer of the city this dispute shall be settled by the mayor after
consultation with the city attorney. The mayor shall have the power to delegate
to any appointed officer any such duty which is to be performed when no specific
officer has been directed to perform this duty. (‘69 Code, §

31.05 Mayor pro tem.
During a temporary absence or disability of the mayor, the city council
shall elect one of its members to act as mayor pro tem, who during the absence
or disability shall possess the powers of mayor as provided by statute.

31.06 Formal occasions.
The mayor shall act for and on behalf of the city on formal occasions and
receptions. In his absence or inability to attend any function the council may
select any other officer to so act. (‘69 Code, § 31.025)
Article 2.City Council
31.10 Election functions.
The members of the council shall be elected and serve a four-year term as
provided by statute. The council shall be the legislative division of the city
government and shall perform such duties and have such powers as may be
authorized by statute. (‘69 Code, § 31.050)
31.11 Meetings.
The regular meetings of the city council shall be held in the council
room, City Hall, 1165 S. Water St., Wilmington, IL on the first and third
Tuesdays in each month at the hour of 7:00 p.m. If the regular meeting falls on
a legal holiday, the meeting shall take place on the next day at the same hour
and place. Adjourned meetings may be held at such other times as the council may

31.12 Special meetings.
Special meetings of the council may be called by the mayor or three
aldermen, provided written notice of the meeting is given to each member of the
council at least 24 hours before the time set for the meeting. In case all the
elected members of the council are present at any special meeting then the
requirement of notice shall be unnecessary and shall be deemed waived.

31.13 Presiding officer.
The mayor shall be the presiding officer of the council at all regular or
special meetings and when the council meets as a committee of the whole.

31.14 Quorum.
A majority of the elected members of the council shall constitute a quorum
thereof. No ordinance shall be passed except upon the favorable vote of a
majority of the elected members, as provided by statute. (‘69 Code, §

31.16 Standing committees.
The following shall be the standing committees of the city
council:
(A) Finance, administration and land acquisition
committee;
(B) Ordinance and licenses committee;
(C) Water, sewer,
streets and alleys committee;
(D) Personnel and collective bargaining
committee;
(E) Buildings, grounds, parks, health and safety
committee;
(F) Police ESDA committee;
(G) Anyone wanting to be on the
agenda will notify the mayor or city administrator at least two days prior to

31.17 Special committees.
The city council shall appoint such special committees as it may deem
necessary. (Ord. 1115, passed 1-8-91)
31.18 Membership in committees.
(A) The city council shall appoint the members of all standing and special
committees as it may deem necessary.
(B) Every committee of the council
shall consist of five aldermen including co-chairmen unless the city council
shall provide otherwise. In the case of the committee on personnel and finance,
that committee shall be composed of the chairmen of all standing committees
designated in Section 31.16. (‘69 Code, § 31.090; Ord. 944,

31.19 Records.
The city clerk shall keep the minutes and records of the council
proceedings. (‘69 Code, § 31.095)
31.20 Disturbing meetings.
No person shall disturb any regular or special meeting of the city council
or of any committee thereof or behave in a disorderly manner at such meeting.
Any person violating any provision of this section shall be fined not less than
$25 nor more than $750 for each offense. (‘69 Code, § 31.100;

31.21 Order of business.
The order of business at meetings of the city council shall be as
follows:
(A) Pledge to the flag;
(B) Approval of
minutes;
(C) Mayor’s report;
(D) Citizen’s
comments;
(E) Treasurer’s report;
(F) Planning and zoning
commission report;
(G) Police commission report;
(H) Downtown
revitalization report;
(I) Committee reports;
(J) City
administrator’s report;
(K) Attorney’s report;
(L) Anyone
wanting to be on the agenda will notify the mayor or city clerk at least two
days prior to the regular meeting. (‘69 Code, § 3.001; Am. Ord.

31.22 Rescinded action.
No vote or action of the city council shall be rescinded at any special
meeting unless there are present at the special meeting as many members of the
council as were present at the meeting when the vote or action was taken, as
provided by statute. (‘69 Code § 3.005)
31.23 Resolutions.
At the request of any 2 members of the council, any resolution submitted
to the city council shall be reduced to writing before being voted on.

31.24 Addressing meetings.
No person other than the mayor or a member of the city council shall
address that body at any special or regular meeting of the council except on
consent of a majority of the members present. (‘69 Code, §
3.015)
31.25 Suspension of rules.
The rules of order, other than those prescribed by statute, may be
suspended at any time by the consent of a majority of the members present at any
meeting. (‘69 Code, § 3.020)
31.26 Robert’s Rules of Order.
Robert’s Rules of Order shall govern the deliberations of the city
council except when in conflict with any of the foregoing rules. (‘69

Article 3.City Clerk
31.30 Appointment.
The city clerk shall be elected and serve for a 4-year term and until his
successor is appointed and qualified as provided by statute. (‘69 Code,
§ 31.150)
31.32 Signatures.
The city clerk shall seal and attest all contracts of the city and all
licenses, permits, and other such documents which require this formality.

31.33 Money collected.
The clerk shall turn over all money received by him on behalf of the city
to the city treasurer promptly on receipt of the same and shall give a statement
as to the source thereof. (‘69 Code, § 31.165)
31.34 Accounts.
The clerk shall keep accounts showing all money received by him and the
source and disposition thereof, and such other accounts as may be required by
statute or ordinance. (‘69 Code, § 31.170)
31.35 Records.
In addition to the record of ordinances and other records which the clerk
is required by statute to keep; he shall keep a register of all licenses and
permits issued, the payments thereon, a record showing all of the officers and
regular employees of the city, and such other records as may be required by the
council. (‘69 Code, § 31.175)
31.36 Seal.
The clerk shall be the custodian of the city seal and shall affix its
impression on documents whenever it is required. (‘69 Code, §
31.180)
31.37 Documents.
The clerk shall be the custodian of all documents belonging to the city
which are not assigned to the custody of some other officer of the city by the
mayor or council. (‘69 Code, § 31.185)
31.38 Indexes.
The clerk shall keep and maintain a proper index to all documents and
records kept by him so that ready access thereto and use thereof may be had.

31.39 Additional duties.
In addition to the duties herein provided the clerk shall perform such
other duties and functions as may be required by statute or ordinance or
approved by council. (‘69 Code, § 31.195)
