Article 1. Bicycles
75.01 Application to persons riding bicycles.
Every person riding a bicycle on a roadway shall be granted all the rights
and shall be subject to all of the duties applicable to the driver of a vehicle
by this title, except as to special regulations in this title and except as to
those provisions of this title which by their nature can have no application.

75.02 Clinging to vehicles.
No person riding a bicycle, sled, or any toy vehicle on any street shall
cling to or attach himself or his vehicle to any moving motor vehicle or wagon.

75.03 Obedience to traffic-control devices.
Any person operating a bicycle shall obey the instructions of official
traffic-control devices applicable to vehicles unless otherwise directed by a
police officer. Whenever authorized signs are erected indicating that no right
or left or U-turn is permitted, no person operating a bicycle shall disobey the
direction of any sign, except where the person dismounts from the bicycle to
make any turn, in which event the person shall then obey the regulations
applicable to pedestrians. (Ord. 636, passed 9-15-70) Penalty, see Section

75.04 Parking.
No person shall park a bicycle upon a street. Bicycles may only be parked
on sidewalks in such a manner as to afford the least obstruction to pedestrian

75.05 Riding on sidewalks.
No person shall ride a bicycle on a sidewalk within a business district.

75.06 Bicycle equipment.
(A) Every bicycle, when used during the period when lighted lamps are
required under this title shall be equipped on the front with a lamp which shall
emit a white light visible from a distance of at least 500 feet to the front and
with a red reflector on the rear. A lamp emitting a red light visible from a
distance of 500 feet to the rear may be used in lieu of a red
reflector. (B) Every bicycle shall be equipped with a brake which will enable
the operator to make the braked wheels skid on dry, level, clean
pavement.
(C) No person shall operate a bicycle unless it is equipped with a
bell or other device capable of giving a signal audible for a distance of at
least 100 feet, except that a bicycle shall not be equipped with, nor shall any
person use, any siren or whistle upon a bicycle.
(D) The parent of any child
and the guardian of any ward shall not authorize or knowingly permit any child
or ward to violate any provision of this chapter. (Ord. 636, passed

Article 2. Motorcycles
75.15 Traffic laws to apply.
Every person operating a motorcycle shall be granted all of the rights and
shall be subject to all of the duties applicable to the driver of any other
vehicle under this title, except as to those provisions of this title which by
their nature can have no application. (Ord. 636, passed 9-15-70)
75.16 Riding on motorcycles and bicycles.
(A) The operator of a motorcycle, bicycle, or tandem bicycle shall ride
only astride the permanent or regular seat or saddle attached thereto, and the
operator shall not permit more than one other person to ride thereon nor shall
such other person ride on the motorcycle, bicycle, or tandem bicycle unless it
is designed to carry two people, in which event the passenger shall also ride
astride the permanent and regular seat or saddle if it is designed for two
persons, or astride another seat or saddle at the rear of the operator. Any seat
or saddle designed for a passenger must be equipped with permanent hand grips
and, in addition, the motorcycle, bicycle, or tandem bicycle must be equipped
with foot rests adjusted to fit the passenger. A side car may be attached to a
motorcycle in which additional persons may ride.
(B) A person shall ride
upon a motorcycle, bicycle, or tandem bicycle only while sitting astride the
seat, facing forward, with one leg on each side of the vehicle.
(C) No
person shall operate a motorcycle, bicycle, or tandem bicycle while carrying a
package, bundle, or other article which prevents him from keeping both hands on
the handlebars.
(D) No operator of any motorcycle, bicycle, or tandem
bicycle shall carry any person nor shall any person ride in a position that will
interfere with the operation or control of the vehicle or the view of the

75.17 Operation of motorcycles.
(A) All motorcycles are entitled to full use of a lane and no motor
vehicle shall be driven in such a manner as to deprive a motorcycle of the full
use of a lane. This division (A) shall not apply to motorcycles operated two
abreast in a single lane.
(B) The operator of a motorcycle shall not
overtake and pass in the same lane occupied by the vehicle being
overtaken.
(C) No person shall operate a motorcycle between lanes of traffic
or between adjacent lanes or roads of vehicles.
(D) Motorcycles shall not be
operated more than two abreast in a single lane.
(E) Divisions (B) and (C)
shall not apply to police officers in performance of their official duties.

75.18 Clinging to vehicles.
No person riding upon a motorcycle shall attach himself to any other
vehicle on a roadway. (Ord. 636, passed 9-15-70)
75.19 Reckless driving.
Any person who operates a motorcycle on one wheel is guilty of reckless
driving as set out in Section 73.13. (Ord. 830, passed 10-6-81) Penalty, see

Article 3. Snowmobile Operation and Safety
75.25 Snowmobile Registration and Safety Act adopted by reference.
Articles I, IV, and V of the Snowmobile Registration and Safety Act
hereinafter called the “Act,” as amended, are incorporated by
reference as if fully set forth herein. (Ord. 719, passed 1-3-78; Ord. 1532,

75.26 Registration.
No person shall hereafter operate any snowmobile within the corporate
limits of the city unless the snowmobile has been registered and numbered in
accordance with the Act and unless the certificate of number awarded to the
snowmobile is in full force and effect and the identifying number set forth in
the certificate is displayed on each side of the cowling of the snowmobile.

75.27 Equipment.
All snowmobiles operated within the corporate limits of the city shall be
equipped as required by the provisions of Article IV of the Act. (Ord. 719,

75.28 Operation.
It is unlawful for any person to drive or operate any snowmobile in the
city in a manner prohibited by Article V of the Act. (Ord. 719, passed 1-3-78)

75.29 Use of city streets.
All operators of snowmobiles shall leave the city by using city streets
from their homes to the nearest exit from the city to the snowmobile trail
desired to be used. The streets of the city shall only be used by snowmobiles
for the purpose of leaving and entering the city. All persons operating
snowmobiles on the city streets as above set forth will remain on or as close as
possible to the right side of the roadway. There shall be no operation of
snowmobiles within the city limits on the following streets:
(A) Water
Street between Mill Street and Baltimore Street.
(B) Route 102 between
Baltimore Street and Kahler Road.
(C) Route 53 between Daniels Street and

75.30 Emergency.
In the event of an emergency, the restrictions as to routes and the use
and operation of snowmobiles within the city may be waived for the operation of
snowmobiles that may be summoned or used in an emergency provided the emergency
is declared by the:
(A) Chief of police.
(B) Fire
chief.
(C) Mayor.
(D) Civil defense coordinator.

75.31 Sticker required.
Each snowmobile shall be provided with a Wilmington Vehicle Sticker as
provided for other motor vehicles. (Ord. 719, passed 1-3-78)
75.32 Compliance with traffic regulations.
In addition to the directions for operation of snowmobiles hereinabove set
forth operators must obey all traffic regulations as prescribed for motor
vehicle traffic and are subject to the same penalties for violation thereof.

75.99 Penalty.
Any person, firm or corporation violating any provision in this title, for
which another penalty is not provided, shall for a first conviction be fined not
less than $25 nor more than $750, for a second conviction within one year
thereafter, the person, firm or corporation shall be fined not less than $100
nor more than $750 and for a third or subsequent conviction within one year
after the first conviction, the person, firm or corporation shall be fined not
less than $250 nor more than $750. A separate offense shall be deemed committed
on each day during or which a violation occurs or continues. (Ord. 1574, passed
